Protecting Sellers

It is critical that Sellers of real property are familiar with disclosures required by Florida law and understand the importance of addressing these matters at the time of listing their property. In addition, if title problems such as boundary overlaps or encroachments are identified early in the process, the Seller's real estate attorney will have sufficient time to resolve them without delaying a closing date or "losing" a contract. Finally, a Seller should always be represented by a real estate attorney at the closing table to address any unexpected issues that could result in a delay of the closing if not handled immediately and to assure that closing documents have been properly prepared and executed.

Protecting Buyers

When considering the purchase of real property, a Buyer should never underestimate the importance of having an experienced real estate attorney assist with the preparation or review of a proposed contract. The real estate contract will dictate such matters as the amount of the deposit, the circumstances under which the deposit may be released or refunded, the time frame for inspecting the property, the Seller's obligation to pay the cost of certain repairs, the Buyer's intended use for the property, whether the property is subject to assessments or homeowner's association dues, the process for resolving survey or title problems, the allocation of closing costs, the closing date and dispute resolution.

Prior to closing on real property, the Buyer's real estate attorney should review the boundary survey of the property, title related information including the title commitment, and all closing documents. The Buyer's real estate attorney will assure that the closing documents are executed properly and should irregularities arise at the closing table, the Buyer's real estate attorney will be there to advise the Buyer as to their rights and obligations under the contract.

Assisting with "Land Use" Related Issues

Buyers often overlook "land use" related matters when purchasing real property. Land use involves the effect of local, state, regional and federal regulations on a property owner's use and enjoyment of real property. In the context of a real estate transaction, most Buyers consider "land use" regulations to be synonomous with "zoning" regulations. However, "zoning" regulations are just one facet of "land use" regulations. For example, the zoning district may dictate the type of use that is allowed (for example, residential, multifamily, commercial) but the zoning designation alone does not assure that the property can actually be developed or used accordingly. A well-drafted real estate contract will address these types of matters by requiring the Seller to make representations and warranties as to the suitability of the property for the Buyer's intended use (including a provision that these warranties survive the closing), or in the alternative, will provide a sufficient period of time to the Buyer to investigate land use matters and obtain reports, certifications and government approvals if necessary in order to use the property as intended.

Governmental Permitting and Governmental Law

It is imperative that a Real Estate Attorney understand the effect of governmental regulation on the use of real property. Leslie Campione has served in the capacity of "city attorney" for three separate municipalities in Lake County since 1995. She currently serves as the City Attorney for the City of Umatilla in Lake County. She is a member of the Florida Bar's Environmental and Land Use Section and stays informed on proposed and newly enacted laws that impact landowners and local governments.
