Lake County Land Use and Zoning Lawyer

There are a multiple levels of land use regulations that affect a landowner's ability to use or develop real property. Most property owners are familiar with the concept of local zoning regulations and the types of restrictions imposed by zoning laws, including allowable uses, setbacks, and minimum lot sizes. In the State of Florida, each local government is required by State law to adopt an extensive set of "Land Development Regulations" and a local blueprint to guide and regulate growth referred to as a "Comprehensive Plan." A local government's Land Development Regulations and Comprehensive Plan are subject to tough scrutiny by the State of Florida Department of Community Affairs to assure that local regulations comply with Statewide rules policies for management growth in the State of Florida.

In addition, she is familiar with the various levels of land use regulation enforced by regional, State and federal agencies such as the Regional Water Management Districts, the Florida Department of Environmental Protection, Florida Fish and Wildlife Conservation Commission, FEMA, the Army Corp of Engineers, and the U.S. Environmental Protection Agency.

Assisting with "Land Use" Related Issues Related to Real Estate Transactions

Depending on whether a Buyer is purchasing vacant land or land that has been improved, the "land use" issues may be very different but equally complex. Many local governments in Florida and in Lake County continue to adopt more stringent land development regulations in order to provide greater control and oversight by local governments over redevelopment and new development. When purchasing improved property, it is critical that a Buyer to determine whether the existing structure and use conform to current regulations and if not, whether the property is considered "grandfathered" or "vested" from the new rules should improvements be made to the property or if the improvements are destroyed.

If a Buyer is purchasing vacant land, it is critical that diligent research be conducted to determine the allowable uses for the property and any physical limitations associated with the site such as environmental and drainage constraints. If new development is being proposed, a Buyer should be fully apprised of the local land development regulations, including whether a land use change is required in order to use the property for the Buyer's intended purpose.
