The Impact of Land Use Regulations on Individual Landowners, Interested Parties and the Public at Large

A landowner's proposed use of a particular tract often impacts two different groups: first, adjacent landowners or residents that may experience the direct physical impacts of the type or density of the land use, and second, the community at large that may experience a direct or indirect financial impact in the form of increased or decreased taxes and greater demands on public services. The landowner and the effected parties expect their elected officials to represent their best interests, and local officials often find themselves caught in the middle of these competing values. Ultimately, these competing interests should operate in tandem with each side respecting the other's perspective thereby resulting in the protection of individual freedoms and the effective utilization of land. Through long-term comprehensive planning, an effective local government will protect all property owners through fair and flexible regulations that:

  • Encourage innovative design and well-planned traffic circulation for all developments;
  • Create a sense of place through architecture, site design and proper use of the physical attributes of the land;
  • Mitigate negative impacts on surrounding properties through landscaping, screening and sufficient buffers;
  • Promote economic prosperity by facilitating commercial uses in appropriate locations within close proximity to the customer base;
  • Assure environmental protection and efficient site utilization;
  • Offer a wide variety of housing types and products for various income groups;
  • Facilitate industrial uses while effectively mitigating off-site impacts;
  • Assure coordination between all agencies that provide public services, utilities and schools;
  • Facilitate the public acquisition of land for parks, conservation, active and passive recreation, and historic and archeological preservation; and
  • Promote the continuation of agricultural uses through green belt exemptions and the purchase/transfer of development rights.
